Terms of use

About these terms

These are the rules for using The Games Wall at thegameswall.com. In these terms, “we” means whoever runs the site, named under Contact at the end. By making an account or using the site, you agree to these terms. If you don’t agree, please don’t use the site.

Our privacy notice says what we do with your information. Our copyright and reports page says how to tell us about something that shouldn’t be here.

Who can have an account

  • You must be 16 or older.
  • An account is for one person. Keep your sign-in to yourself.
  • What you tell us must be true.

Putting a game up

Only put up a game you made, or one you have permission to promote. What you tell us about it must be true. Some games on the wall are our own picks, put up to show off games we like. If you made one of them, get in touch and we’ll move it to your account or take it down.

The team board

The team board is for finding people to make games with. We don’t check posts or the people behind them. Take care before sharing personal details, and never pay anyone to join a team. Any deal you make with someone you meet here is between you and them.

The feed

The feed is for talking about games. Your profile and posts are public, and so are your comments on games. We may limit how much you can post or comment, to stop spam. Only the person who put a game on the wall can post announcements for it, and an announcement must be about that game.

What you can’t put up

Nothing that:

  • is illegal, or links to something illegal, including child sexual abuse material, terrorist content and fraud;
  • copies someone else’s work, name or brand without permission;
  • is sexual, hateful or threatening, or harasses anyone;
  • shares someone else’s private information without their permission;
  • is a scam, spam or malware, or pretends to be someone else;
  • tries to break, overload or get round the security of the site.

What you put up, and what we can do with it

What you put up stays yours, and you are responsible for it. You give us permission to store it, copy it as needed to run the site, and show it on the site and in posts about the site, for as long as it’s up. That permission is worldwide, free, and not exclusive, so you can use your work anywhere else too. You promise you have the right to give it.

Reports and taking things down

We don’t check what people put up before it appears. Anyone can report something, from a Report link, from the ⋯ menu on a post, or by emailing us. The reports page says what to include.

We look at reports and remove what is illegal or breaks these terms. When enough people report a post, it may be hidden until we’ve looked at it. We may also warn people, suspend accounts, and close accounts that break these terms badly or repeatedly. We usually tell the person why, unless the law stops us or it would put someone at risk.

We may pass information to the police or other authorities when the law requires it, or when we think it is needed to protect someone from serious harm.

If you think we got something wrong, email us and we’ll look again. You can take down your own plots and posts whenever you like, and you can ask us to delete your account.

Ads on the feed

  • You can show one of your own posts as an ad, if it’s about a game you put on the wall. It is marked as an ad, with your handle on it.
  • Ads are free. The days and the start date are shown before you book. Days are limited and go to whoever books them first.
  • We don’t promise any number of views or clicks. The ads page says how we count them.
  • An ad must follow these terms like any post, and the UK’s advertising rules, the CAP Code. Be honest about the game, and don’t mislead people about what it is or costs. We don’t check ads before they run. We can pause or end an ad at any time if we think it breaks the rules, or after reports.
  • If you delete the post, its ad ends.

Plots

  • Plots are free, one for each game. Nothing on the site costs money. If that ever changes, the price will be shown before anyone pays, and these terms will say how refunds and cancelling work.
  • Where your plot sits on the wall changes from time to time, so each plot takes a turn in the middle. Your plot keeps its size.
  • The Guest Spot is won by votes. It can’t be bought.
  • A plot stays up until you take it down or we remove it under these terms. We may change, pause or stop parts of the site. If we close the site, we’ll give you reasonable notice.

Other people’s games and links

We aren’t responsible for other people’s games, posts, links or websites. Game stores and other sites have their own rules. Being on the wall doesn’t mean we back a game or promise it is any good or safe.

Our work

The site’s design, code, name and logo belong to us. Please don’t copy or resell them, or collect the site’s content in bulk. Games, names and pictures that other people put up belong to them.

Our responsibility

We take reasonable care to keep the site running, but we can’t promise it will always be available or free of mistakes. We may change, pause or stop parts of it, for example for maintenance or security.

Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t let us limit. Nothing in them affects your legal rights as a consumer.

If you use the site as a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or of our negligence. Loss is foreseeable if it was an obvious result, or if you and we both knew it might happen.

If you use the site for business, for example to promote your game, we aren’t responsible for lost profit, lost revenue, lost data or other indirect loss. The most we are responsible for is what you have paid us in the 12 months before the problem.

Changes

We may change these terms, for example when the law, the site or our security needs change, or to fix a mistake. When we do, the date at the top changes too. If it’s a change that matters to you, we’ll say so on the site first. Using the site after that means you accept the new terms.

Complaints and the law

If you have a complaint, email us and we’ll do our best to put it right. If we can’t settle it, you may be able to use an approved alternative dispute resolution provider. We’ll tell you about one if it comes to that.

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your own courts. If you live somewhere else, you keep the consumer protections of the place you live.

The small print

If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term straight away, we can still do it later. We may hand our rights and duties under these terms to another business that takes over the site, and we’ll tell you. You can’t hand yours to anyone else.
